PLANNED CHAOS LIMITED - TERMS OF SERVICE

BACKGROUND: 

This agreement applies as between you, the User of this Web Site (www.beckmann-norway.co.uk) and Planned Chaos Limited t/a Parent Studio, the owner(s) of this Web Site.  Your agreement to comply with and be bound by these terms and conditions is deemed to occur upon your first use of the Web Site. If you do not agree to be bound by these terms and conditions, you should stop using the Web Site immediately.


  1. Definitions and Interpretation 

In this Agreement the following terms shall have the following meanings:  


“Content”

means any text, graphics, images, audio, video, software, data compilations and any other form of information capable of being stored in a computer that appears on or forms part of this Web Site;

“[ Company Name ]”

means Planned Chaos Limited – Unit 1201 Westfield Shopping Centre, 1 Ariel Way London;

means collectively any online facilities, tools, services or information that Planned Chaos Limited  makes available through the Web Site either now or in the future;

means any online communications infrastructure that Planned Chaos Limited  makes available through the Web Site either now or in the future.  This includes, but is not limited to, web-based email, message boards, live chat facilities and email links;

means any third party that accesses the Web Site and is not employed by Planned Chaos Limited  and acting in the course of their employment; and

“Web Site”

means the website that you are currently using (www.beckmann-norway.co.uk) and any sub-domains of this site (e.g. subdomain: www.beckmann-norway.co.uk/bags) unless expressly excluded by their own terms and conditions.

    • All Content included on the Web Site, unless uploaded by Users, including, but not limited to, text, graphics, logos, icons, images, sound clips, video clips, data compilations, page layout, underlying code and software is the property of Planned Chaos Limited , our affiliates or other relevant third parties. By continuing to use the Web Site you acknowledge that such material is protected by applicable United Kingdom and International intellectual property and other relevant laws.
    • Subject to sub-clause 2.3 you may not reproduce, copy, distribute, store or in any other fashion re-use material from the Web Site unless otherwise indicated on the Web Site or unless given express written permission to do so by Planned Chaos Limited .
    • Material from the Web Site may be re-used without written permission where any of the exceptions detailed in Chapter III of the Copyright Designs and Patents Act 1988 apply.

    • You agree that, if you have provided Planned Chaos Limited with personal data relating to a third party (1) you have in place all necessary appropriate consents and notices to enable lawful transfer such personal data to Planned Chaos Limited  and (2) that you have brought to the attention of any such third party the Privacy Notice available on the Planned Chaos Limited ’s website or otherwise provided a copy of it to the third party. We make no guarantee of any specific results from the use of our Service.

  3. Availability of the Web Site

The Service is provided “as is” and on an “as available” basis.  We give no warranty that the Service will be free of defects and / or faults.  To the maximum extent permitted by the law we provide no warranties (express or implied) of fitness for a particular purpose, accuracy of information, compatibility and satisfactory quality. We reserve the right to instantly refund an order should we deem it to be of  B2B nature or suspected fraud. Due to the scarcity of some products we may have a 2 person maximum per order eg: rain covers.

Planned Chaos Limited t/a Parent Studio  accepts no liability for any disruption or non-availability of the Web Site resulting from external causes including, but not limited to, ISP equipment failure, host equipment failure, communications network failure, power failure, natural events, acts of war or legal restrictions and censorship.

  1. Limitation of Liability
    • To the maximum extent permitted by law, Planned Chaos Limited accepts no liability for any direct or indirect loss or damage, foreseeable or otherwise, including any indirect, consequential, special or exemplary damages arising from the use of the Web Site or any information contained therein. Users should be aware that they use the Web Site and its Content at their own risk.
    • Nothing in these terms and conditions excludes or restricts Planned Chaos Limited ’s liability for death or personal injury resulting from any negligence or fraud on the part of Planned Chaos Limited .
    • Every effort has been made to ensure that these terms and conditions adhere strictly with the relevant provisions of the Unfair Contract Terms Act 1977. However, in the event that any of these terms are found to be unlawful, invalid or otherwise unenforceable, that term is to be deemed severed from these terms and conditions and shall not affect the validity and enforceability of the remaining terms and conditions.  This term shall apply only within jurisdictions where a particular term is illegal.
  2. No Waiver

In the event that any party to these Terms and Conditions fails to exercise any right or remedy contained herein, this shall not be construed as a waiver of that right or remedy.

  1. Previous Terms and Conditions

In the event of any conflict between these Terms and Conditions and any prior versions thereof, the provisions of these Terms and Conditions shall prevail unless it is expressly stated otherwise.

  1. Notices

All notices / communications shall be given to us either by post to our Premises (see address above) or by email to sales@beckmann-norway.co.uk .  Such notice will be deemed received 3 days after posting if sent by first class post, the day of sending if the email is received in full on a business day and on the next business day if the email is sent on a weekend or public holiday.

  1. Law and Jurisdiction

These terms and conditions and the relationship between you and Planned Chaos Limited  shall be governed by and construed in accordance with the Law of England and Wales and Planned Chaos Limited  and you agree to submit to the exclusive jurisdiction of the Courts of England and Wales.

  1. Codes and offers 

Please note the following conditions regarding general offers and discount codes:

- Only one code can be used per transaction.
- Codes cannot be combined with any other offer, sale, or discount.
- Codes can only be redeemed online.
- Offers have an expiration date and cannot be used retroactively.
- The terms of each code may vary, so please refer to the specific advertisement for more information.
- Certain products are excluded from all offers and discounts; please check the product page for further details.

- Spare parts are excluded from any offers, codes, or discounts.

  1. Beckmann Norway Brand Specific Warranty

The customer has the right of complaint pursuant to the consumer protection legislation applicable at any given time, such legislation may vary from country to
country. The rights of the customer under the consumers’ protection legislation
applicable at any given time are additional to those under the “Extended
Warranty” and are not affected thereby.

What is approved
All Beckmann products come with the following warranty period against
production defects:
- Suitcases: 5 years – or in line with local legislation requirement depending
which period is longer
- Backpacks: up to 4 years – or in line with local legislation requirement
depending which period is longer
- Other products: 2 years – or in line with local legislation requirement depending
which period is longer

In the event of a warranty case, the warranty period will not be extended by
further years, the warranty period is always valid from the date of purchase. As
of 2019, the consumer can also receive up to 4 year warranty on backpacks by
registration of the backpack and the name at beckmannofnorway.com
("Extended Warranty"). Registration must be completed within 1 year from the
date of purchase.
The warranty covers production and material defects, not damage caused by
external factors.

External factors affecting a backpack can be (and are not limited) to the
following:
• Cracked plastic parts due to hard pressure (e.g., under a chair leg or in a
door)
• A rip in the back pack due to an accident
• The backpack worn with only one shoulder strap, which causes the seam
to loosen in the transition between the backpack and the strap
• Washing the backpack in a machine
• The backpack is filled so much that the zipper bursts.

External factors on a suitcase can be as follows:
• Damage during handling by airline
• Slippage from heights

The warranty does not cover wear and tear due to ordinary use, overloading of
the product, minor material deviations on e.g. colors, as well as factors such as
sunlight, temperature, humidity and pollution. Damage caused by accidents,
transportation, collisions or accidents and theft is not covered by the warranty.
